Jul 2, t2, 9 ORDINANCE NO. 2009-002 AN ORDINANCE TO ADOPT THE MULTI-JURISDICTIONAL COMPREHENSIVE PLAN FOR RACINE COUNTY AS THE COMPREHENSIVE PLAN FOR THE TOWN OF NORWAY The Town Board of the Town of Norway, Racine County, Wisconsin, do ordain as follows: SECTION 1. Pursuant to Section 62.23, Section 61.35, and Section 60.22(3) of the Wisconsin Statutes, the Town of Norway is authorized to prepare and adopt a comprehensive plan as defined in Sections 66.100(1) 66.100(1)(a) and 66.1001(2) of the Wisconsin Statutes. SECTION 2. The Town Board of the Town of Norway, Wisconsin, has adopted written procedures designed to foster public participation in every stage of the preparation of a comprehensive plan, as required by Section 66.1001(4)(a) of the Wisconsin Statutes. SECTION 3. The Town has cooperated with Racine County and SEWRPC to prepare a multi-jurisdictional comprehensive plan for the County that will serve as the comprehensive plan for the Town of Norway and Racine County. The Town plan is documented in the report titled "A Multi-Jurisdictional Comprehensive Plan for Racine County: 2035," and information specific to the Town is set forth throughout the report. SECTION 4. The plan commission of the Town of Norway, by a majority vote of the entire commission recorded in its official minutes, has approved a resolution recommending to the Town Board the adoption of the document titled "A Multi-Jurisdictional Comprehensive Plan for Racine County: 2035," containing all of the elements specified in Section 66.1001(2) of the Wisconsin Statutes. SECTION 5. The Town Board has duly noticed and held at least one public hearing on the comprehensive plan, in compliance with the requirements of Section 66.1001(4)(d) of the Wisconsin Statutes. SECTION 6. That Chapter 10 of the Municipal Code for the Town of Norway relating to Building, Zoning and Planning is hereby amended to create Section 10.012, Comprehensive Plan, to read as follows: "Section 10.012 Comprehensive Plan The Town Board of the Town of Norway, Wisconsin, does, by the enactment of this ordinance, formally adopt the document titled, "A Multi-Jurisdictional Comprehensive Plan for Racine County: 2035," pursuant to Section 66.1001(4)(c) of the Wisconsin Statutes, as the Town of Norway comprehensive plan. The comprehensive plan is available for public inspection during normal business hours in the Clerk's office." SECTION 7. This ordinance shall take effect upon passage by the Town Board and publication and posting as required by law. Jul 2, t1 Notice of Complete Application for Proposed Dredging and Grading Town of Raymond, 2255 76th Street, Franksville, WI 53126 has applied to the Department of Natural Resources for a permit for grading more than 10,000 square feet on the bank of Root River Canal and for dredging. The proposed project consists of removing downed trees and accumulated debris that are obstructing flow from 9 locations within the Root River Canal. Non-native trees and trees with high potential of falling across the river will also be removed from the bank. The project is located along the Root River Canal between 5 Mile Road and 8 Mile Road, in portions of Sections 3, 10, 14 and 15, in the Town of Raymond, Racine County. The Department has determined that the application is complete and is currently evaluating the applicant's proposal. The Department must consider factual information about the following legal standards in deciding whether to issue, modify, or deny the approval or permit to the applicant: n Whether navigation is materially obstructed, including commercial, recreational, active and passive forms of navigation n Whether there is detriment to the public interest, including fish and wildlife or their habitat, natural scenic beauty or water quality n Whether the flood flow capacity of a stream is materially reduced The Department will follow the steps below to reach its final decision on the application: 1. Review the plans and information provided by the applicant. 2. Review the information from public comments. 3. Review the information presented at a public informational hearing if one is requested. 4. Review the information found in natural resource inventories and plans, maps, or data collected by the Department or others using commonly accepted methods. 5. Determine whether the proposed project or activity complies with s. 1.11, Stats [the Wisconsin Environmental Policy Act], and ch. NR 150, Wis. Adm. Code. The Department has made a tentative determination that it will issue a permit with possible modifications to the proposed activity.
